Terms of Service
These Terms govern your use of Crush & Crash (the “Game”), operated by CosmicGateway Services Inc (“we”, “us”, “our”) at https://crushncrash.fun. By accessing the Game, connecting a wallet, or signing the SIWE message, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Game.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction). The Game contains mature themes and gambling-style mechanics involving on-chain assets and is not suitable for minors. The Game may be unavailable, restricted, or prohibited in certain jurisdictions; you are solely responsible for complying with the laws that apply to you. Access where prohibited is void.
2. Accounts & Wallets
You sign in with a self-custodied wallet via SIWE. We do not custody your wallet, private keys, or seed phrase, and will never ask for them. You are responsible for the security of your wallet and for all activity under it. We may, with or without notice, suspend functionality, impose limits, or close accounts to comply with law, mitigate risk, or protect users.
3. The Game
Crush & Crash is an entertainment experience offering tap-style and crash-style game modes with on-chain settlement on Base. The Game uses provably-fair RNG (commit-reveal seeds verifiable after each session). In-game items, currencies, cards, cosmetics, and other digital assets (“Virtual Goods”) are part of the Game experience and have no guaranteed real-world value unless expressly stated. We may add, modify, suspend, retire, or rebalance any Virtual Good, feature, or smart-contract mechanism at any time, in our sole discretion.
4. Purchases & Wagering
You may purchase items or place on-chain bets using USDC. All purchases and bets are final and non-refundable except where required by law; we may, at our discretion, issue a one-time courtesy credit. You are responsible for network gas fees and any taxes that apply to you. You acknowledge that you may lose any USDC you wager. Outcomes are not predictable. Only wager what you can afford to lose.
5. Acceptable Use
You will not: use bots, scripts, or automation; manipulate game outcomes, the economy, or RNG; circumvent purchase limits, geo-restrictions, or compliance checks; engage in fraud, money laundering, or any illegal activity; interfere with our infrastructure or smart contracts; reverse-engineer the Game; infringe our or anyone else's IP or other rights; harass other users; or sybil-attack referrals. Any feedback you provide is assigned to us and may be freely used. “Crush & Crash”, related marks, characters, and assets are our intellectual property and licensed to you for personal, non-commercial use only.
6. Disclaimers & Limitation of Liability
THE GAME IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. We do not guarantee the security, stability, availability, or performance of the Game, of Base mainnet, of USDC, of any wallet, or of any third-party service. Any unintended malfunction (software errors, exploits, oracle or RPC failures, BI pipeline issues, etc.) immediately voids associated gameplay results, multipliers, payouts, and rewards during the affected period, and we may reset accounts, pause functions, or reverse off-chain grants in response. On-chain transactions are generally irreversible; we cannot recover lost or stolen digital assets due to user error, third-party breaches, or blockchain-network disruptions.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION. OUR AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100. We are not responsible for failures or delays caused by circumstances beyond our reasonable control.
7. Disputes
Any dispute, claim, or controversy arising out of or relating to these Terms or the Game will be resolved by binding arbitration on an individual basis. YOU AND WE EACH WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitration will be conducted under rules, by a neutral arbitrator, and at a venue we may reasonably designate at the time the dispute is initiated. To the extent arbitration is unenforceable for any reason, the parties consent to the exclusive jurisdiction of the courts having jurisdiction over our principal place of business. Any claim must be brought within ONE (1) YEAR after it accrues, or it is permanently waived.
8. Changes & Contact
We may update these Terms at any time. Material changes will be communicated via the Game's homepage and the “Last Updated” date above. Continued use after the effective date constitutes acceptance.
